Terms of Service

Section 1. Definitions

we: Elibri sp. z o. o., a limited liability company incorporated under the laws of Poland, with its seat in Warsaw (address Grottgera St. 9a/7, 00-785 Warsaw), with a tax identification number (NIP): 5213483769, registered in the register of entrepreneurs maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register (KRS), under the KRS number: 0000306422, share capital PLN 50,000, e-mail address:e-mail: kontakt@elibri.com.pl

User or You: An individual or legal person utilizing the Application within the scope of its business or professional activity.

Application: The service provided by us electronically on your behalf under the name W3C AUDIOBOOK PACKAGER. The service is accessible through our website at bookery.app.

Input Files Audio files (audiobook recording) or graphic files (cover) uploaded by you to the Application, based on which you create the final audiobook archive in the Application.

Device: Your electronic device from which you upload Input Files and on which you can download the file with the final audiobook.

Additional Paid Services: Additional functionalities of the Application described on the Application's website for which we charge fees.

Section 2. Application description and technical requirements

  1. Application Features:

    1. Using the application, you can create an audiobook with correct metadata based on uploaded Input Files.

    2. You can place all Input Files of your audiobook in a zip archive. Thanks to an additional file, publication.json, with metadata, players and listening applications will be able to load the metadata prepared by you.

  2. Technical Requirements:

  3. Audio Input Files should be in the following formats: wav, mpeg, mp4, mp3, ogg, webm, aac, aacp, flac.

  4. The device should have the latest version of the operating system, an up-to-date web browser, and access to the internet.

Section 3. Application usage rules

  1. Use of the application is free.

  2. Additional charges apply for the use of paid additional services, as indicated in the description of each service on the application's website.

  3. We do not store files. All Input Files and those generated in the Application are deleted within 24 hours. After completion, download the final audiobook archive to your device.

  4. You may use Application up to 20 times per 30 days.

  5. Any actions that may affect the proper functioning of the application or the use of the application in a manner contrary to the terms of service, legal regulations, or good manners are prohibited.

  6. Uploading or placing content of an unlawful nature, violating good manners, or infringing on copyrights or other rights of third parties is prohibited in the Application.

Section 4. Complaints and liability

  1. If the application does not work correctly or you want to report any other irregularities related to the application, file a complaint.

  2. Complaints should be submitted: By email – to the address: kontakt@elibri.com.pl, with the note "Complaint W3C AUDIOBOOK PACKAGER."

  3. The complaint should include a description of the error and contact information.

  4. The complaint will be processed within 14 days from the date of receiving a complete complaint.

  5. We are not responsible for the temporary unavailability of the application or for any potential damages you may incur due to the use of the application, unless it is a result of our deliberate fault.

  6. Before uploading files to the application, make backups of Input Files. BTW, making regular backups of essential files is always advisable.

Section 5. Final provisions

  1. Those Terms are available on the Application’s website.

  2. We may change these Terms at any time.

  3. Insofar as it is allowable, all legal relations following from these Terms and use of Application will be governed by Polish law.

  4. Any jurisdiction matters will be determined by the applicable provisions of European Union law and, where that law allows for a choice of jurisdiction to be made, the chosen jurisdiction will be that of Polish courts.
